When transferring (1) or selling forest material, the transferor must prove to the receiver the legality of the possession of the forest material and the receiver must check it.
Data and documents certifying the legality of possession of forest material are:
- an entry in the real estate book proving ownership;
- a contract for the transfer of felling rights or forest material with annexes or a summary deed in the event that the sale takes place from the seller's warehouse, on which the forest material comes from different cadastral units and is stored together - the form of the summary deed can be obtained from a representative of Combiforest OÜ with instructions for execution;
- an entry registering felling or a forest protection expert act in the forest register;
- identification document;
- the waybill(s) is necessary to prove the shipment.
In addition, the seller of forest material must provide:
juridical person
- a valid copy of the register card of part B of the commercial register;
- the VAT registration number of the person subject to VAT;
- power of attorney of the transferor's (seller's) representative in case the seller's representative is not indicated on the register card of Part B of the commercial register. The power of attorney must be signed by a member of the company's board.
the self-employed
- a valid copy of the register card of part B of the commercial register;
- the VAT registration number of the person subject to VAT;
- power of attorney of the transferor's (seller's) representative in case the seller's representative is not indicated on the register card of Part B of the commercial register. The power of attorney must be signed by the entrepreneur.
physical person
- power of attorney of the representative of the transferor (seller) if the seller is not the transferor of the material. The power of attorney must be signed by the seller.
The recipient (buyer) adds copies of the documents proving the legality of the possession of forest material to the buyer's copy of the purchase-sale deed.
